Terms of Use

These Terms of Use ("Terms") are an agreement between you and Envirolyte USA LLC, a Florida limited liability company ("Envirolyte USA," "we," "us"), 2115 SW 2nd St, Pompano Beach, FL 33069. They cover the Envirolyte Learning Academy at envirolytelearningacademy.com (the "Academy"). By creating an account or using the Academy, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Academy.

The Academy is for business and professional use. You must be at least 18 years old and have the authority to accept these Terms for yourself and, if you register for a company, for that company.

All content in the Academy is educational. It reflects Envirolyte USA's understanding of on-site generation technology and sanitation operations at the time it was recorded. It is not legal, regulatory, safety, engineering or medical advice, and you remain responsible for your own decisions and compliance.

Educational content is not a statement that any Envirolyte product or any generated solution is registered, approved, cleared or suitable for a particular use, including on food-contact surfaces, in a particular facility, or under any regulation. Registrations, allowed claims and approved uses differ by product, use and location. Product labels, safety data sheets and the rules that apply to your facility control. Always check with Envirolyte USA and qualified professionals before changing your operations.

• Keep your sign-in details secure. You are responsible for activity on your account.
• Give accurate information when you register and keep it current.
• Do not share your account or let anyone else use it.
• Tell us right away if you think your account has been used without permission.

We give you a limited, personal, non-exclusive, non-transferable right to watch Academy content through the Academy for your own business learning. You may not:

• download, copy, record (including screen recording), redistribute, resell or publicly post the videos or other content;
• remove copyright or other notices;
• use scripts, bots or other automated tools to access or extract content without our written permission;
• try to get around the video protections or access other users' accounts or our systems; or
• use the Academy to break the law or to interfere with its operation or security.

If you send a consultation or inquiry request, we may use what you submit to respond to you. Sending a request does not create a consulting, advisory or contract relationship. Any services will be covered by a separate written agreement between you and Envirolyte USA.

The Academy relies on services from others, including Vimeo for video and Google for sign-in. Their own terms and privacy policies apply to their services, and we are not responsible for them.

The videos, text, graphics, logos and other materials in the Academy are owned by or licensed to Envirolyte USA and protected by copyright, trademark and other laws. "Envirolyte USA" and related marks belong to their owners. Except for the right described above, you receive no rights in them.

We want the Academy to be usable by everyone and are working toward meeting the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have trouble using any part of it, contact us and we will work with you. See our Accessibility Statement for more.

You may stop using the Academy and ask us to delete your account at any time. We may suspend or end your access if we reasonably believe you broke these Terms, if you misuse the Academy, or if we stop offering it. Sections that by their nature should continue to apply after your access ends will continue to apply.

THE ACADEMY AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, ENVIROLYTE USA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. RESULTS DEPEND ON FACILITY CONDITIONS, EQUIPMENT, CHEMISTRY AND OPERATING PRACTICES, AND WE DO NOT PROMISE ANY PARTICULAR RESULT.

TO THE FULLEST EXTENT THE LAW ALLOWS, ENVIROLYTE USA AND ITS OWNERS, OFFICERS, EMPLOYEES AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE ACADEMY OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE ACADEMY WILL NOT EXCEED US$100.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Broward County, Florida, and you agree to those courts' authority over you.

We may change or end any part of the Academy. We may also update these Terms. When we make a material change, we will update the "Last updated" date and, where appropriate, tell you directly. If you keep using the Academy after the change takes effect, you accept the updated Terms.

If a part of these Terms cannot be enforced, the rest still applies. These Terms and the Privacy Policy are the whole agreement between you and us about the Academy. You may not transfer your rights under these Terms. We may transfer ours as part of a sale or reorganization.
